TERMS OF SERVICE
Understanding the sales tax policy is important to avoid any surprises at the time of purchase. In New York, retail sales tax is a destination tax, which means that the rate of tax to be collected is determined by the point of delivery or possession transfer. Sales delivered outside the state are exempt from tax.
Product Availability and NSN Numbers:

Please be aware that orders placed without prior confirmation of product availability run the risk of not being fulfilled. If we are unable to fulfill the order due to lack of stock, your order will be cancelled and refunded according to our Refund Policy.
Your understanding and cooperation in this aspect are highly appreciated, as this policy helps us maintain a smooth and efficient order fulfillment process.
We strive to process and ship all orders within 2 business days, using USPS or UPS. Orders received before 12pm Mon-Fri usually ship the same day, while orders received on weekends are dispatched on Mondays. However, we cannot guarantee a specific delivery time frame, as unforeseen events such as weather, mechanical issues, or pandemic-related causes may cause delays. Please note that some items may come from multiple stores or manufacturers, and may arrive in separate packages. Tracking numbers are emailed to customers upon shipping, but may take up to 24 hours to post from the time of pickup. For more information, please refer to our Shipping Policy.
We want our customers to be satisfied with their purchases. If for any reason you are not happy with your purchase, we accept unused items back within 14 days, provided that they are in the same condition as when received, with all parts/components in resalable condition. Please make sure that all packaging is included. In the event that items are used, damaged, or not resalable, we may not be able to offer a refund. At Smith’s Surplus and Supply, we want you to be completely satisfied with your purchase. If you need to return an item, we’ll gladly refund your original form of payment within 3 business days of receiving your return at our facility.
Orders placed without confirming availability of NSN specific orders / products and we have to cancel the order due to non-availability, any related credit card processing fees and potential shipping charges that have already been incurred (such as when a shipping label has been purchased) will be deducted from the refund.
Please keep in mind that for general order cancellations or changes of heart, refund will have credit card processing fees and any shipping charges deducted from the balance where applicable. Note that it may take up to 10 business days for your financial institution to process the refund, based on their policies. Additionally, a 15% restocking fee may apply in certain circumstances.
We, unfortunately, have no control over your financial institution’s policies and cannot act as an intermediary between you and them. Hence, we advise customers to adhere to our NSN product ordering guidelines and ensure to cancel their orders before a shipping label is purchased.

Clearance Items: All Sales Final
Please be aware that all clearance items purchased on our e-commerce store are considered final sales and are not eligible for returns, exchanges, or refunds. These items are sold at significantly reduced prices due to limited stock, discontinued lines, or seasonal clearance, and as such, we cannot accept any returns or offer refunds for these products.
Before making a purchase, we encourage customers to carefully review the product descriptions, sizing information, and images to ensure that the clearance item meets their expectations. If you have any questions or concerns about a clearance item, please do not hesitate to contact our customer support team prior to completing your purchase. We are more than happy to provide any additional information or clarification that you may require.
By purchasing clearance items from our e-commerce store, you acknowledge and agree to these terms and conditions, and understand that all clearance item sales are final and non-refundable. We appreciate your understanding and thank you for your continued support of our business.
Lost or Damaged Items:
If a package is lost or damaged, it is the customer’s responsibility to report the loss to Smith’s Surplus and Supply in a timely manner. Lost UPS packages must be reported within 30 days of the original ship date, while lost USPS packages must be reported within 90 days of the original ship date. Claims cannot be opened after these time periods, and Smith’s Surplus and Supply assumes no responsibility for claims made after these time periods. Please note that claims cannot be opened for packages shipped via Standard Shipping or UPS SurePost.
Upon placing an order, the customer’s credit card is charged for the full dollar amount of the order. In the event that we are unable to ship the order in part or in full, we will refund the customer for that portion. For security reasons, we may request a copy of the customer’s identification and credit card in certain circumstances.
Promotional & Coupon Offers/Clearance Items:
We may offer coupons or discounts on certain products, but please note that some brands may not participate in these sales. Sale prices only apply to new purchases and we cannot offer a credit after an order has been placed. Coupons cannot be combined with other offers, and only one coupon code can be used per order.
Customers must be 18 years or older to purchase a knife, and must understand that it is not designed or intended for use as a weapon. By purchasing any item from Smith’s Surplus and Supply, the buyer certifies that he/she is in compliance with local and state laws and legally able to purchase these items. Please check your local laws before purchasing these items, as we cannot be held responsible for advising or restricting use.
By purchasing body armor from us, customers certify that they have not been convicted of any crime that would restrict them from being able to purchase or possess body armor under any Federal or State laws. We are unable to ship body armor products to the state of Connecticut or outside of the United States, and cannot accept returns for these products in order to protect our customers and maintain chain of custody. Please check your local laws before purchasing body armor.
1. Pre-Order Reservation
When placing a Pre-Order with Smith’s Surplus and Supply, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. Smith’s Surplus shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information. You can update your information at any time prior to your product being shipped by sending an e-mail to [email protected]
You acknowledge and agree that Smith’s Surplus and Supply may decline or delay reservations to avoid oversubscription or as it deems appropriate, provided that we will make efforts to inform you within two (2) weeks of our receipt of your Pre-Order, and that you will be entitled to a full refund of the purchase Price.
You will be charged the full Price of the Products at the time of placing the Pre-Order. If Smith’s Surplus and Supply is unable to commence shipping the Products within four weeks of placing the Pre-Order, Smith’s Surplus and Supply shall notify you. Your placing of a preorder constitutes your express agreement to Smith’s Surplus and Supply of charging the full Price of the Products at such time.
4. Delivery Schedule
Although we will make efforts to begin delivering Products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery (ETD) is only an estimate, is subject to change, and Smith’s Surplus and Supply does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, Smith’s Surplus and Supply is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you periodical updates with respect to such delivery schedule. If for any reason you decide that you do not wish to continue to wait for your Product, you may cancel your reservation as provided for in Section 6 below.
The purchase price (“Price”) does not include taxes and other government charges, which are your responsibility. If the Price drops after you have pre-ordered, we will refund you the difference. If the Price goes up, your order is secure at the low Price. The Pre-Order Price is valid from the moment you place the Pre-Order right up to 10 days after you receive the item. You or Smith’s Surplus and Supply may cancel this reservation by terminating the Pre-Order at any time for any or no reason prior to our notice to you that your Product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase Price without interest. If Smith’s Surplus and Supply cancels your reservation you will receive a full refund of the purchase Price without interest (and you will not pay any processing fee).

The Smiths Surplus and Supply mobile message service (the “Service”) is operated by Smiths Surplus and Supply (“Smiths Surplus and Supply”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Smiths Surplus and Supply’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Smiths Surplus and Supply through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Smiths Surplus and Supply. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18444886424 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Smiths Surplus and Supply mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
