Sales Tax:
New York’s retail sales tax is a destination tax. The point of delivery or the point at which possession is transferred by the seller to the purchaser determines the rate of tax to be collected. Sales delivered outside New York State are exempt from tax.
Shipping:
The customer is responsible for all shipping costs unless otherwise stated. We utilize USPS and UPS for our shipping needs. All orders are processed within 2 business days. Orders received before 12pm Mon – Fri usually ship the same day. Orders received on the weekend are dispatched on Mondays.. While we do everything we can to ensure a timely delivery, unfortunately we can’t guarantee that your package will arrive in any particular time frame. Sadly, there are instances where UPS or USPS will be late due to unforeseen events such as weather in transit, mechanical issues or pandemic related causes. If your package has been delayed beyond its scheduled delivery time, we will not be able to refund any shipping charges. Please be aware that UPS and USPS do not have any guarantees as to the delivery time of their ground service.
Please note that some items may come from multiple stores or our manufactures bases on inventory. Please allow more than 1 package in some cases. We will try to inform during shipping however it is not guaranteed and will work hard to communicate with you. Tracking numbers are emailed to customers upon shipping. Returns:
We want to make returns easy. If you are not happy for any reason we will take unused items back within 14 days. Items are to be in the same condition as when received, all parts / components must be resalable condition for a full refund. Please be sure that all packaging is included. In the event they are used, damaged or not resalable we may not be able to offer a refund. Please see our full return policy for details.
In the event a package is refused or not pick up from a post office or UPS and returned to us, Shipping for the return freight along with the original actual freight cost will be deducted from any refund due. Any free shipping promotion will be void.
Order Cancellation:
Credit card processing fees will be deducted from any refund due. Refunds take 5-10 days to appear on a customer’s statement. No restocking fees will apply.
Lost or Damaged Items:
Should a package be lost or damaged, it is the customer’s responsibility to report the loss to Smith’s Surplus and Supply in a timely manner. Lost UPS packages must be reported within 30 days of the original ship date of the package. Lost USPS packages must be reported within 90 days of the original ship date. The postal service will not allow us to open a USPS claim before 45 days from the original ship date. If you feel that your USPS package has been lost, you must submit your concern to us. Please be aware that claims cannot be opened after 90 days, and Smith’s Surplus and Supply assumes no responsibility for claims made after these time periods. Please note any shipment that goes out via Standard Shipping or UPS SurePost may not be rerouted once it has been shipped.
Credit Cards:
Upon placing an order with Smith’s Surplus and Supply the customers’ credit card is charged for the full dollar amount of the order. In the event we are not able to ship your order in part or full we will refund your order for that portion. We strive to ship all orders complete however there are at times stock counts and not accurate and errors are made. We apologize for any inconvenience.
In the event we issue a refund it may take your financial institution up to 10 business days to post the funds back into your account or statement. Smith’s Surplus and Supply has no control over the time your bank will process the refund or return and we can not act as an intermediary between the bank and the customer.
In order to prevent fraud and protect our customers at times we will request a copy of your identification and possibly card. This may occur if the shipping address is different then the card holder’s billing address, other fraud flags or the sale amount warrants further checks.
Promotional & Coupon Offers/Clearance Items:
Smith’s Surplus and Supply may offer coupons or discounts and some brands do not participate in these sales. We will do our best to include this in the offer. We do run sales and promotions that we will email or post on our website. Please understand that sale prices only apply to new purchase and we can not offer a credit after an order has been placed.
Coupons will also not work when combined with other offers such as free shipping or a % or $ amount discount. We only allow one coupon code to be used per order. If a free item is offered but a discount code is used at checkout it may remove the free item.
Knives / Batons / OC Spray:
All customers attempting to purchase a knife must be 18 years or older. Knives are sharp, and by purchasing the knife from Smith’s Surplus and Supply you understand that it is not designed or intended for use as a weapon. Smith’s Surplus and Supply does not warrant that a person may legally purchase, possess, or carry any specific items offered, according to federal, state or local laws. By purchasing any item from Smith’s Surplus and Supply, whether by phone, mail, electronic mail (email) or in person, the buyer grants that he/she is in compliance with local and state laws and legally able to purchase these items. By acceptance our terms, you the purchaser agrees that Smith’s Surplus and Supply has no liability to you the purchaser or any person for any claim, loss, damage or expense arising from handling, use, display, or storage of the knife.
Be sure to check your local Knife, Baton, Pepper Spray & Stun Gun laws in your state, county, city, or town. You may be violating your local laws if you possess these items. We do not know the laws and can not be held responsible for advising you or restricting your use. It is your responsibility to know the laws where you live and you should check with local law enforcement before buying/possessing this item.
Body Armor
United States law restricts possession of body armor for convicted felons. Many U.S. states also have penalties for possession or use of body armor by felons. Smith’s Surplus and Supply is unable to ship any Body Armor, Plates, Shields, etc. to the state of Connecticut or outside of the United States. By purchasing body armor from us you are certifying that you have not been convicted of any crime that would restrict you from being able to purchase or possess body armor under any Federal or State laws. Furthermore, you are acknowledging that you do not intend to use the body armor for any criminal purpose and that you are over the age of 18 years old. In order to protect our customers and keep chain of custody we are unable to accept return for body amour products.

The Smiths Surplus and Supply mobile message service (the “Service”) is operated by Smiths Surplus and Supply (“Smiths Surplus and Supply”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Smiths Surplus and Supply’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Smiths Surplus and Supply through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Smiths Surplus and Supply. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18444886424 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Smiths Surplus and Supply mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
